I've seen numerous assertions on Jackie's videos of Behind My Eyes that the release has been copied from the song "True Faith" by the English rock band, New Order, released in 1987, and a few say it is plagiarized. Does anyone have information with regard to the validity of these assertions?.....or the consequence of it being "too similar"?

Does anyone have information with regard to the validity of these assertions?.....or the consequence of it being "too similar"? To me, people who say that kind of thing are trying to discredit Jackie's original songs. I thought this comment was good from YouTube, "It is not a "remake", and the melody is not "100 percent the same". The only thing similar is the rhythm with accent on the 2nd and 4th beat with a rim-shot on the snare, common standard drum beat in Rock and R&B. Get past the drum beat and you won't hear anything close to a remake."

Not even close. This is ridiculous to even suggest in light of the Ed Sheeran copyright court case that he won.
Singer-songwriter Ed Sheeran emerged victorious after a years-long legal battle over one of his most popular songs. Sheeran's trial came to a close as jurors concluded he did not steal key elements of Marvin Gaye's 1973 classic, Let's Get It On, to create his Grammy-winning 2014 hit, Thinking Out Loud.
Ed played various chord progressions on his guitar during the trial to demonstrate that virtually all pop music uses variations of the same chord progressions. There are literally thousands of songs that do this. And just because some chord pressions may be the same, does not mean one "stole" someone else's music. The jury agreed with Ed after he had demonstrated with numerous examples of the use of the same chord progression, but the manner one played it created unique compositions.
It is only "plagiarism" if one outright makes a carbon copy of how the music was played with no attempt to change anything.
Look at Taylor Swift when her past song catalog got sold out from under her. Taylor re-did ALL these songs in what is now known as "Taylor's Version". Not much of a stink was raised here. In fact, no stink. Taylor changed enough to not "plagiarize" her original version but one still recognizes the originals within the new versions. And roughly half of the sales for her older material are for "Taylor's Version".
On top of this, Jackie wrote the lyrics for Behind My Eyes and together with Greg Camp came up with a melody that they both thought fit the message being presented in the songwriting. Who did more on the music side is unclear as they both have producer credits for the song.
This is one of the most ridiculous claims on Jackie's song Behind My Eyes that I have ever seen, especially in light of Ed Sheeran and Taylor Swift.

Thank you geb, The similarity between BME and True Faith SEEMS debatable with regard to the rhythm and drum beat, and that was my concern, not knowing to what degree the similarity might warrant investigation. Although Ed Sheeran emerged victorious, there was a question of whether or not "key elements" were stolen, and it did go to court. I'd hate to see Jackie and Greg have to defend their arrangement, even though their case would likely be won, if not dismissed. The average listener would not be aware of Ed Sheeran's case and therefore assume the assertions to be "ridiculous" in light of it. Just the repeated mention in numerous comments on Jackie's videos that BME was copied, a remake", or plagiarized, might invoke a question of Jackie's integrity. Of course that has been the intent.

Lawrence, it is not even within the same ballpark, the same solar system, hell, the same universe, of it being debatable that the two songs are similar. Here is True Faith by New Order by the Chords and Melody: www.hooktheory.com/theorytab/view/new-order/true-faithHere is Behind My Eyes by the Chords and Melody: www.hooktheory.com/theorytab/view/jackie-evancho/behind-my-eyesJackie's song is written in G Minor. With the following analytics: New Order's song is written in D Minor. With the following analytics: Whomever thinks Behind My Eyes and True Faith are essentially the same, are completely bonkers. They need to have their ears checked. This is complete baloney and an attempt to blatantly, and falsely, discredit an artist. Pretty disgusting if you want my opinion.

Same for the other posters that make the provably FALSE statement that the choruses and melodies of the songs are the same or similar. One can plainly see for themselves that the notes played for each song in the chorus are not even close to one another. These people are totally bonkers and need to have their ears checked, and should spend a minute or two looking at the sheet music for each song that also plainly shows them to be quite different from each other. It really is disgraceful for people to not bother to do any homework before making what could be called scandalous statements that are easily disproven as complete bull with a less than 5 minute Internet search on each song

There is similarity in the relative note progression, but the key and rhythm and overall effect are quite different, and clearly fitted to different lyrical content.
